Keeping of Animals

WAC 246-203-130Keeping of Animals, addresses health, sanitation, and nuisance associated with animal keeping, mainly as it relates to manure handling and disposal. In 2009, the Board received a petition to amend the rule. The Board denied the specific petition and directed staff to file a CR-101, Preproposal Statement of Inquiry, to explore issues and update the rule.

The rulemaking stalled and ultimately resumed in 2017. In 2019, the Board withdrew the original CR-101 and filed a new CR-101 to better align the rulemaking with Board policy direction established in a background report completed the prior year. Further rulemaking then followed revising the rule and developing the accompanying rule analyses.

On March 23, 2022, the Board filed a CR-102, Proposed Rule, as WSR 22-08-003 for the  Keeping of Animals rule. The filing invited public comment and announced the public hearing on the proposed rule.

On June 8, 2022, the Board held a public hearing and considered public comment on the proposed rule. At the hearing’s conclusion, the Board adopted the proposed rule along with several amendments to the rule language. The rule includes a title change to Domestic Animal Waste and standards for the handling and disposal of animal excreta, or animal waste, for the purpose of preventing and controlling nuisance and health hazards. All material considered at the public hearing is available at the Board’s web page for the June 8 meeting and public hearing. Staff are now finalizing material to file the adopted CR-103P, Rulemaking Order. When filed, the Board will notify the rule project's interested parties and others on the Board's general distribution list.
