Emergency Rule Banning Vitamin E Acetate in Effect Through March 19

The Centers for Disease Control and Prevention recently announced that the national outbreak of vaping-associated lung injuries has declined and appears to be linked most closely to tetrahydrocannabinol (THC)-containing vaping products. The emergency rule the Board passed at its November 2019 public meeting that bans the sale of vapor products containing vitamin E acetate remains in effect through March 19. The Board will consider extending the rule at its public meeting on Wednesday, March 11 in Tumwater. The emergency rule passed by the Board that temporarily banned the sale of flavored vapor products, including flavored THC vapor products, expired February 8. Board members passed that emergency rule in October 2019 in response to Governor Jay Inslee’s executive order issued in September of the same year. The Governor’s actions were prompted by a national and state outbreak of vaping-related lung injuries among people who reported using vapor products.
