Rulemaking Delegation - Sanitary Control of Shellfish - Minimum Performance Standards

Summary

The State Board of Health (Board) is required to make rules to ensure that shellfish are safe to eat. The Board gave the Department of Health (Department) the ability to update WAC 246-282-005(1)(a) in November 2024. The Department adopted by reference the 2023 version of the National Shellfish Sanitation Program’s Guide for the Control of Molluscan Shellfish to ensure that the most current health and safety requirements are in the rule as required by statute. The CR-103P was filed as WSR 25-06-081 on March 4, 2025. If you want to know more about these rule changes, you can check out the Department’s website here: Sanitary Control of Shellfish 2023 Model Ordinance Adoption | Washington State Department of Health
