Keeping of Animals Rule Update: Overview, Next Steps and Rule Timeline

The Keeping of Animals rule addresses health, sanitation, and nuisance associated with animal keeping, mainly as it relates to manure handling and disposal.

In November 2020, staff presented a revised draft rule for consideration by members of the State Board of Health (Board). The Board directed staff to file a CR-102, Proposed Rule. Next steps include preparation of required analyses, distribution of the proposed rule for public review and comment, response to comments, and a public hearing. Interested parties will be notified when the CR-102, Proposed Rule, is filed and the hearing is scheduled.

The Board received a petition to amend the rule in July 2009. The Board denied the specific petition and directed staff to file a CR-101, Preproposal Statement of Inquiry, to explore issues and update the rule. Work on the rule stalled and the Board devoted time to issues and concerns with large animal feeding operations and related regulatory programs.

In 2018, Board staff completed a background report on environmental health concerns and the regulatory structure managing animal waste. The report also outlines Board policy recommendations modernizing the rule.

In October 2019, the Board withdrew the original CR-101 and filed a new CR-101 to better align the scope of the rulemaking with Board policy direction. Following work with stakeholders on rule language, the Board circulated a draft rule for public review and comment in early 2020.
